WORK AND SPECIAL RELEASE AGREEMENT

Eligibility of an inmate to participate in the SWMCCC "Work & Special Release" program is possible only by an order within the criminal commitment, special court orders of the sentencing judge or authorization of the SWMCCC Operations Administrator.

The "Work & Special Release" agreement will be come effective only after the following conditions are agreed to and accepted by the inmate. It is understood that violation of, or refusal to comply with, any of these conditions shall be sufficient cause for revocation of "Work & Special Release" privileges.

  1. I will go directly to the destination approved for "Work & Special Release" and, upon completion of the reason for being released, will return directly to the Correction Center.
  2. I will not have in my possession, nor use, any unauthorized drugs to include alcoholic beverages. I will freely cooperate and voluntarily submit to medical and chemical tests, and examinations for the purpose of determining use of unauthorized drugs, including intoxicating beverages, when so ordered by the Administrator or his authorized representative.
  3. I will obey all municipal, state and federal laws, and all rules and regulations of the SWMCCC and will in all respects conduct myself honorably.
  4. I will not have in my possession or under my control, any weapons or firearms for any purpose. I will not attempt to bring any contraband into, or attempt to smuggle anything out of, the Correction Center.
  5. Should I ever be on unauthorized leave from the Correction Center, I hereby waive extradition to the State of North Dakota for any jurisdiction where I may be found.
  6. I will promptly and truthfully answer all inquiries directed to me by the administrator or designated representative, concerning all aspects of my release.
  7. I will commute to and from my "Work or Special Release" site only by means approved by the Administrator or his authorized representative.
  8. I will not attempt to visit with my family, relatives, or friends at the work site or at any other locations, as visits are to be held during visiting hours at the Correction Center.
  9. I will not leave my "Work or Special Release" site for any reason other than job-related circumstances.
  10. I will make no personal phone calls from outside of the Correction Center, except to call the Correction Center.
  11. I will not send anything through the mail except through the Correction Center.
  12. I will notify the Correction Center Administrator, or representative, immediately of any job or program status changes (ex. change of hours, job or program termination, etc.).
  13. I hereby agree to pay to the Correction Center, for inmate variable expenditures (ex. "Work and Special Release" expenditures, room and board, etc.), at the rate of Fifteen Dollars ($15.00) for each day released for employment.
  14. I will not bring any contraband into the facility. Any contraband brought into the facility (ex. tobacco, lighters, knives, magazines, etc.) will be discarded. All money must be turned into staff and not left in pockets or locker. Any violations of these rules, I will receive a write-up and possible loss of work release privileges.
  15. I WILL HAVE ALL MY WORK RELEASE PAYMENT PAID IN FULL ONE MONTH BEFORE MY RELEASE DATE. IF MY WORK RELEASE ISN’T PAID I WILL NOT BE ALLOWED TO GO TO WORK UNTIL MY WORK RELEASE IS PAID IN FULL. IF I MAKE AN OVER PAYMMENT I WILL BE REIMBURSED BY THE SOUTHWEST MULTI-COUNTY CORRECTION CENTER. IT IS MY RESPONSIBILITY TO MEMO THE FRONT OFFICE REQUESTING A CHECK FOR THE OVER PAYMENT.
  16. Work release will be allowed to have one place of employment during their stay at S.W.M.C.C.C., unless, they previously had two places of employment prior to their incarceration.

12-44.1-18.2. Work release program - Room and board costs to be paid by inmate.
Any inmate who participates in a work release program shall pay the correctional facility for the room and board costs incurred by the inmate while confined in the correctional facility, residential halfway house, or similar alternative facility. The administrator shall determine the amount of meal and lodging costs to be paid by the inmate. The amount to be paid by the inmate while confined in a correctional facility may not exceed fifteen dollars per day or the funds earned by the inmate, whichever is less. The amount to be paid by the inmate while placed in a residential halfway house or similar alternative facility may not exceed the actual cost per day or the funds earned by the inmate, whichever is less.
